# Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the website located at uyney8-ys.myshopify.com and any successor domain (the "Site"), operated by Pawmony ("Pawmony," "we," "us," or "our"). By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.


These Terms should be read together with our Privacy Policy, Shipping Policy, and Refund Policy, which are incorporated by reference.

## 2. Eligibility


You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on the Site. By using the Site, you represent that you meet this requirement, or that you are using the Site under the supervision of a parent or legal guardian.


## 3. Products and Pricing


We make reasonable efforts to accurately display our products, including through descriptions and images. However, we do not warrant that product descriptions, photographs, or other content on the Site are entirely accurate, complete, or error-free. Some product imagery may be digitally generated or stylized to represent the product; actual items may vary slightly in appearance.


All prices are listed in Euros (EUR) and are inclusive of applicable VAT unless stated otherwise. We reserve the right to change prices at any time without prior notice, but changes will not affect orders that have already been confirmed. We reserve the right to correct pricing errors, including after an order has been placed, and to cancel any order affected by a pricing error, in which case you will receive a full refund.


## 4. Orders


When you place an order, you are making an offer to purchase the product(s) in your cart. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity. An order is not confirmed until you receive an order confirmation email from us.


## 5. Payment


We accept payment through the methods displayed at checkout. By providing payment information, you represent that you are authorized to use the chosen payment method. All payments are processed securely through our third-party payment processors; we do not store your full payment card details.


## 6. Shipping and Delivery


Please refer to our Shipping Policy for full details. In summary:


- Orders are fulfilled through third-party suppliers, and items may ship directly from overseas warehouses.
- Estimated delivery times vary by destination and are typically longer than domestic-warehouse retailers — please check the estimated delivery window shown on the product page or at checkout before ordering.
- Delivery estimates are not guaranteed and may be affected by customs processing, carrier delays, or other circumstances outside our control.
- You are responsible for providing an accurate shipping address. We are not liable for orders delayed or lost due to incorrect address information provided at checkout.
- Depending on your location, your order may be subject to import duties, customs fees, or taxes charged by your local authorities upon arrival. These charges are your responsibility and are not included in the item price or shipping cost.


## 7. Right of Withdrawal (EU Consumers)


If you are a consumer located in the European Union, you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason, in accordance with EU Directive 2011/83/EU on consumer rights.


To exercise this right, you must inform us of your decision to withdraw by clear statement (for example, by email to dogproducts6@gmail.com) before the 14-day period expires. You will then need to return the goods to us within 14 days of that notification, in their original condition where reasonably possible. You are responsible for the direct cost of returning the goods unless we have agreed otherwise. Upon receiving the returned item, we will reimburse the price paid, including standard delivery charges, within 14 days.


This right of withdrawal is separate from, and in addition to, any warranty or guarantee rights you may have under applicable consumer protection law. Further detail on returns and refunds is set out in our Refund Policy.


## 8. Cancellations


You may request to cancel an order before it has been dispatched to the supplier for fulfillment by contacting us at dogproducts6@gmail.com. Once an order has been placed with our supplier for fulfillment, we may not be able to cancel it, in which case the Right of Withdrawal described above will apply instead.


## 9. Intellectual Property


All content on the Site, including text, graphics, logos, product images, and the Pawmony name and branding, is the property of Pawmony or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as necessary to make a personal, non-commercial purchase.


## 10. Acceptable Use


You agree not to:


- use the Site for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorized access to the Site, our systems, or any related network;
- interfere with or disrupt the operation of the Site;
- use any automated system (bots, scrapers, etc.) to access the Site without our prior written permission;
- submit false, misleading, or fraudulent information, including at checkout.


We reserve the right to suspend or terminate your access to the Site if we reasonably believe you have violated these Terms.

The Site may contain links to third-party websites or rely on third-party services (such as payment processors and fulfillment partners). We do not control and are not responsible for the content, policies, or practices of any third-party sites or services. Your use of such third-party services is subject to their own terms and privacy policies.

To the fullest extent permitted by applicable law, Pawmony disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.


Nothing in this section limits any statutory rights you have as a consumer that cannot lawfully be excluded, including your rights under EU consumer protection law regarding the conformity of goods.


## 13. Limitation of Liability


To the fullest extent permitted by applicable law, Pawmony shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site or a purchased product shall not exceed the amount you paid for the product giving rise to the claim.


This limitation does not affect any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or liability for fraud.


## 14. Indemnification


You agree to indemnify and hold Pawmony harmless from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your violation of these Terms or your misuse of the Site.


## 15. Changes to These Terms


We may update these Terms from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.


## 16. Governing Law and Dispute Resolution


These Terms are governed by the laws of Portugal, without regard to conflict of law principles, without prejudice to any mandatory consumer protection provisions of the country in which you reside, where applicable.


If you are an EU consumer, you may also access the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to seek an out-of-court resolution of a dispute relating to your online purchase.
